WARRANTY AND RETURN POLICY

Effective Date: October 7, 2025

Introduction and Disclaimer

Silent Beacon, LLC (“SBL”) warrants that your Silent Beacon product (the “Beacon”) will be free from defects in materials and workmanship for a period of one (1) year from the date of purchase to the original retail purchaser (“the Warranty Period”). For clients covered under an active Enterprise Safety Solutions (“ESS”) service agreement, warranty coverage continues for the entire duration of the ESS agreement, as described in the ESS Client Warranty section. For purposes of this warranty, a “defect” means a failure of the Beacon to operate substantially in accordance with SBL’s published specifications under normal use conditions. If a defect in the Beacon arises within the Warranty Period, SBL will, at its sole option and subject to applicable laws, repair or replace the Beacon with a new or refurbished Beacon. This repair or replacement shall be your sole and exclusive remedy for any breach of warranty. This Warranty does not apply where the instructions for use and activation of the Beacon were not complied with or where the Beacon is damaged as a result of abuse, accident, modification or other causes beyond our reasonable control. This warranty does not cover normal degradation of battery performance over time, which is expected and not considered a defect. This warranty does not cover software or firmware issues, which may be addressed through updates rather than hardware replacement.

EXCEPT AS EXPRESSLY SET OUT ABOVE AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SBL DISCLAIMS ALL OTHER WARRANTIES. ANY IMPLIED WARRANTIES (INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE) ARE LIMITED IN DURATION TO THE WARRANTY PERIOD SPECIFIED HEREIN. SBL WILL NOT BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. SBL’S TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT PAID FOR THE BEACON (EXCLUDING TAXES, FEES, AND SHIPPING).

Coverage of Limited Warranty

This limited warranty covers only the actual Beacon. All SBL accessories including the wristband, USB-C cord, and attachment clip are not covered under this warranty. Furthermore, SBL’s limited warranty does not cover any products that do not bear the SBL logo. Any repaired or replacement Beacon is warranted for the longer of (i) the remainder of the original Warranty Period or (ii) 90 days.

Compatibility Requirements

For the Beacon to function normally, you acknowledge that you have verified the compatibility of our product with other required equipment. Compatibility issues include, but are not limited to: outdated smartphone operating systems, lack of Bluetooth 5.0 capability, disabled location services, and inadequate cellular service coverage. Lack of compatibility is not a valid claim under the Silent Beacon warranty and does not constitute a basis for receiving a refund after 30 days.

Obtaining Warranty Service

Silent Beacon offers warranty support for both consumers and Enterprise Safety Solutions (“ESS”) clients, with coverage terms and service processes that differ depending on how the Beacon was purchased.

For Consumers (Retail Purchasers)

Consumers are entitled to warranty service for up to one (1) year from the original purchase date, as described in the Limited Warranty above. During this period, if a Beacon is found to be defective in materials or workmanship under normal use, SBL will, at its discretion, repair or replace the product in accordance with this policy.

This Limited Warranty applies only to Beacons purchased and used in the United States and Puerto Rico. Consumers located outside these regions are not covered under this Limited Warranty. SBL does not provide warranty coverage for retail purchases made or used outside the United States and Puerto Rico. International consumers acknowledge that SBL may decline to provide warranty service for Beacons purchased through non-U.S. retail channels.

How to Obtain Consumer Warranty Service

If, after reading online manuals and guides, you are certain that the Beacon is defective, please take the following steps:

(a) Carefully check with the place you purchased the Beacon to see if it is outside their return or limited warranty timeframe.

(b) If you purchased the Beacon(s) directly from silentbeacon.com, please fill out and submit the customer support form by visiting https://silentbeacon.com/customer-support/. Please ensure you include your Order ID and date of purchase.

Once your warranty exchange request is approved by customer support, please follow these steps:

(a) Pack the Beacon(s) carefully (preferably in its original packaging).

(b) Include in the packaging all parts, accessories, manuals, and other materials originally packaged with the Beacon(s).

(c) Include in the packaging a copy of the original sales receipt or other evidence of the date of original purchase, including purchase order if from silentbeacon.com.

(d) Include in the packaging a note (i) that describes the defect that has caused you to return the product, and (ii) that includes a daytime phone number where you can be reached.

(e) Ship the product to the address supplied by SBL’s support team. If you send the packaged product through a postal carrier, at your option, either insure the shipment or accept the risk if the product is lost or damaged in shipment.

State Law Rights

This Limited Warranty gives you specific legal rights, and you may also have other rights which vary by state. For California consumers, implied warranties may not be disclaimed and will last no less than 60 days and up to one year, or as otherwise required by the Song-Beverly Consumer Warranty Act.

Enterprise Safety Solutions (ESS) Client Warranty

ESS clients receive extended warranty coverage for their Beacons for the entire term of their active ESS service agreement, which exceeds the standard one-year warranty period provided to retail purchasers. This enhanced warranty is provided as a benefit of the ongoing ESS service subscription and is contingent upon maintaining an active ESS agreement with SBL.

During the term of the ESS agreement, if the Beacon(s) experiences any defect in materials and workmanship, including battery failure or degradation that affects the Beacon’s functionality, SBL will repair or replace the Beacon(s) at no additional charge to the ESS client. This ESS warranty specifically includes coverage for battery replacement if the battery dies or degrades to the point where it affects the Beacon’s ability to function as intended. This enhanced battery coverage applies only to ESS clients and is not available under the standard Limited Warranty.

How to Obtain ESS Warranty Service

ESS warranty service, including exchanges or replacements, must be initiated by the company’s primary ESS Account Owner (the authorized company representative who manages the ESS Dashboard account). The ESS Account Owner may submit a warranty claim directly through the ESS Dashboard under the “External Links” section. Individual ESS end users cannot submit claims directly and must coordinate all service requests through their company’s ESS Account Owner. ESS warranty coverage applies globally for all active ESS clients, regardless of location. SBL’s support team will confirm eligibility under the ESS agreement and provide instructions for repair or replacement, including shipping and return procedures.

30-Day Return Policy

The following Return Policy applies only to retail consumers who purchased directly through SilentBeacon.com. Enterprise Safety Solutions (“ESS”) clients are not subject to this policy; product exchanges for ESS clients are handled under the terms of their active ESS service agreement as described in the ESS Client Warranty section above.

Silent Beacon allows a 30-day return of the Beacon(s) if purchased directly on SilentBeacon.com. If the Beacon(s) was purchased on a third-party website or through another retailer (reseller), you must abide by their individual return and exchange policies. SBL will not honor or accept returns originally sold by other resellers. If you wish to exchange your Beacon(s) for the same item, SBL may, at its discretion, process the return as an exchange instead of a refund.

To qualify for a silentbeacon.com return, the following conditions must be met:

(a) Confirm you purchased the Beacon(s) directly through silentbeacon.com.

(b) Complete and submit the customer return form at https://silentbeacon.com/customer-support/. Include your Order ID and date of purchase.

If you qualify, the SBL support team will provide return instructions and include the return address.

(a) The product(s) must be in the same condition as originally purchased with no signs of damage, abuse, accident, or modification.

(b) Return the Beacon and all parts included in the original box to the address below.

(c) You must pay for all shipping, taxes, and fees associated with mailing the product back to SBL. We suggest adding insurance and tracking to avoid further delays.

SBL may assess a 10% restocking fee on returned products, at its sole discretion. No restocking fee will be applied to unused Beacons returned in original condition within the return period. We do not reimburse consumers for shipping charges, custom charges, brokerage fees, taxes, duties, or any other fees. Refunds will be processed within 14 business days after SBL receives and inspects the returned Beacon(s). SBL reserves the right to inspect all returned products before issuing any refund. If only partial items are returned, SBL may, at its sole discretion, deny the refund or adjust the refund amount accordingly.

You assume all risk of shipping including lost or damaged products when in transit. This includes any damage that may occur during return shipping, even if properly packaged. SBL retains the right to refuse delivery or may impose an additional restocking fee based on any missing parts or to the product itself.

Additional Terms

Choice of Law and Venue

This Limited Warranty and Return Policy shall be governed by and construed in accordance with the laws of the State of Maryland, without giving effect to any choice of law or conflict of law provisions. To the extent any dispute is not subject to arbitration as set forth in the Dispute Resolution and Arbitration section below, the exclusive venue for such dispute shall be the state or federal courts located in Montgomery County, Maryland, and you hereby consent and submit to the personal jurisdiction of such courts.

Dispute Resolution and Arbitration

Arbitration; Class-Action Waiver

Any dispute arising out of or relating to the Beacon or these terms will be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, held by video, telephone, or in Montgomery County, Maryland, at SBL’s option. You can start arbitration at www.adr.org. YOU AND SBL AGREE TO ARBITRATE SOLELY ON AN INDIVIDUAL BASIS; class, representative, and private attorney general actions are waived.

Costs and Fees For claims under $10,000, SBL will pay filing, administrative, and arbitrator fees to the extent required by the AAA Rules.

Opt-Out of Arbitration You may opt out of arbitration within 30 days of purchase by emailing legal@silentbeacon.com with your name, address, Beacon serial, and a clear opt-out statement.

Small Claims Court

Either party may bring an eligible claim in small-claims court.

This section survives termination.

Severability

If any provision of this Limited Warranty and Return Policy is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Limited Warranty and Return Policy shall otherwise remain in full force and effect and enforceable.

Modification Rights

SBL reserves the right to modify this Limited Warranty and Return Policy at any time by posting an updated version. Your continued use of the Beacon after any such changes constitutes your acceptance of the modified Limited Warranty and Return Policy.

Force Majeure

SBL shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, shortages of transportation facilities, fuel, energy, labor or materials.

Entire Agreement

This Limited Warranty and Return Policy constitutes the entire agreement between you and SBL with respect to the subject matter hereof and supersedes all prior or contemporaneous understandings regarding such subject matter.
